The terms that apply to our services.
These terms and conditions apply to all offers, quotations and agreements between BouwDirect S.L. (hereinafter: 'BouwDirect') and clients, insofar as these terms have not been expressly deviated from in writing.
BouwDirect S.L. is based in Coveta Fuma, El Campello, Alicante, Spain and is part of the Bouwdirect Group.
All quotations from BouwDirect are without obligation and valid for 30 days, unless stated otherwise. An agreement is established upon written confirmation by both parties or once BouwDirect has commenced execution of the works.
Changes to the agreement (additional work) are discussed in advance and recorded in writing. Additional work is charged on a post-calculation basis.
All prices are in euros and exclude VAT (IVA), unless stated otherwise. Payments are made according to the payment schedule set out in the quotation, usually linked to construction phases.
In the event of late payment, BouwDirect is entitled to suspend works until payment is received. Statutory commercial interest applies to outstanding invoices.
BouwDirect carries out all works in accordance with applicable Spanish building regulations and in line with the agreed specifications. Stated delivery dates are indicative and not strict deadlines.
Delays due to force majeure, weather conditions, permit procedures or changes made by the client are outside BouwDirect's responsibility and may lead to adjustments in the planning.
BouwDirect guarantees that the works carried out meet the agreed specifications and applicable building regulations. A warranty period of 10 years applies to structural works in accordance with Spanish law (Ley de Ordenación de la Edificación).
A warranty period of 2 years after handover applies to finishes and installations. Defects must be reported in writing within a reasonable period.
BouwDirect's liability is limited to the amount paid out by the liability insurance or to the invoice amount of the relevant assignment. BouwDirect is not liable for indirect damage, consequential damage or loss of profit.
A joint inspection takes place at handover. Any remaining items are recorded in a handover report and resolved within a reasonable period. The warranty period commences upon approval of the handover.
In the event of cancellation by the client after signing the agreement, costs already incurred and hours spent will be charged. Materials already ordered or delivered will also be invoiced.
BouwDirect assists with applying for required permits from the Spanish authorities. The costs for permits, fees and architectural plans are borne by the client, unless otherwise agreed. BouwDirect is not liable for delays caused by government bodies.
Spanish law applies to all agreements. Disputes shall be submitted to the competent court in Alicante, Spain.
However, the parties shall first attempt to resolve any dispute by mutual agreement before resorting to the courts.
